Terms of Use and Public Offer

These Terms govern access to sayws and, for paid services, constitute an offer to contract on the stated terms. A separately signed customer agreement prevails if it conflicts with these Terms.

Effective date: 28 September 2026

1. Acceptance

By submitting an application with the checkbox selected, signing in to an approved account or continuing to use the service after notice of a change, the customer's authorised representative accepts these Terms and the Privacy Policy.

Submitting an application does not guarantee activation and creates no payment obligation. A paid-plan contract is formed after activation or payment is confirmed through the process presented to the customer.

2. The service

sayws helps businesses receive messages from connected channels, generate AI-assisted replies, hand conversations to staff, maintain a knowledge base and analytics, and manage bookings.

Available channels, limits and features depend on the selected plan. Preview features may change, be temporarily unavailable or be subject to additional terms.

3. Accounts and authority

The customer provides accurate details, assigns staff roles and is responsible for users in its workspace. Anyone accepting these Terms for an organisation confirms that they have authority to bind it.

Passwords and connected-platform tokens must be kept confidential. Suspected compromise must be reported promptly and the affected integration disconnected where possible.

The sign-in and application forms run an automated Cloudflare Turnstile anti-bot check. A request may be refused if the check fails or is unavailable. The Privacy Policy describes the data processed during the check.

4. Acceptable use

The service must not be used for unlawful activity or to violate another person's rights, including to:

  • send spam, malicious code, deceptive or discriminatory messages;
  • collect or transmit data without a lawful ground;
  • evade limits, test vulnerabilities without written permission or disrupt the service;
  • present an automated reply as a binding decision of a doctor, lawyer, bank or public authority without appropriate human review;
  • copy, resell or provide the service to third parties outside the permitted plan.

5. AI output and human oversight

AI output is probabilistic and may be inaccurate, incomplete or out of context. The customer configures the knowledge base and handover rules and tests the system before using it with real people.

The customer remains responsible for products, services, promises and decisions communicated to its customers through the configured assistant. Medical, legal, financial and other high-impact decisions require qualified human review.

6. Customer data

The customer retains rights in uploaded content and grants us a limited right to process it only to provide, secure and improve the ordered service. We do not obtain a right to sell the customer's contact database.

The customer is responsible for lawful data sources, end-user notices and required consents. Personal-data processing is governed by the Privacy Policy and any signed data-processing agreement.

7. Plans, payment and renewal

Price, currency, billing period, limits and payment method are disclosed before a paid plan is activated. No charge is made without prior affirmative agreement. Taxes and mandatory charges are handled under applicable law.

Renewal and cancellation deadlines are shown when ordering. The customer may stop the next period before renewal. Refunds, credits and consumer rights are governed by law, the selected plan and the order; these Terms do not restrict mandatory consumer rights.

8. Intellectual property

The software, interface, design and documentation belong to the service administrator or its licensors. The customer receives a limited, non-exclusive and non-transferable right to use the service during the contract term.

Feedback may be used to improve the product without disclosing customer confidential information or transferring rights in the customer's end-user data.

9. Availability and liability

We take reasonable steps to keep the service available and secure but do not guarantee uninterrupted operation of external platforms, connectivity or AI models. Maintenance and incidents may temporarily limit access.

The parties are responsible for evidenced direct loss to the extent allowed by law and any separate agreement. Nothing excludes liability that cannot legally be excluded or limits mandatory consumer rights.

10. Suspension, termination and disputes

We may restrict access for a security threat, unlawful use, material breach or overdue payment, giving advance notice where practicable. After termination, data is returned or deleted in the manner and period agreed by the parties and required by law.

The laws of the Republic of Kazakhstan apply. Before court proceedings, a party should send a written claim using the contact below; this does not remove a consumer's right to contact the competent authority or court as provided by law.
